1. Bill Has Cleared the House of Lords (Third Reading Completed – 9 March 2026)

During this period, the most significant development is that the Bill has now successfully passed its Third Reading in the House of Lords on 9 March 2026, and has been returned to the House of Commons with amendments.  The Lords approved a small package of technical government amendments, mainly aligning and tightening advertising restrictions, including closing a potential sponsorship loophole for businesses involved in more than one type of prohibited product and explicit inclusion of herbal smoking products and cigarette papers in definitions.

Baroness Merron reiterated the government’s public health rationale, emphasising that smoking remains the leading preventable cause of death in the UK (~80,000 deaths/year).

Peers again highlighted that much of the Bill’s impact will rely on secondary legislation, including upcoming rules on vape flavours, descriptors, device design, advertising restrictions and vape‑free zones.

Legislative consent from the devolved administrations has already been secured—NI (Feb 2025), Scotland (May 2025), Wales (Dec 2025)—with supplementary consents processing following amendments.

ASH published a detailed account on 4 March 2026, summarising the newly adopted amendments and debates — material that continues to underpin political commentary in the second half of March.

Key takeaways from Report Stage include Government amendments adopted to strengthen enforcement and ensure local authorities can easily enforce new restrictions, and the requirement for the government to conduct a formal post‑implementation review 4–7 years after commencement.  New powers were also added to allow ministers to regulate technological features of vaping devices, including those used to “gamify” vaping (digital counters, app integration, reward mechanics).

During this time there was also renewed but unsuccessful lobbying from the cigar industry for differential treatment of cigars.

3. Legal Commentary and Sector Briefings (18 March 2026)

New professional commentary published on 18 March 2026 gives insight into how the Bill will be implemented, which is highly relevant in the last fortnight.  The most notable points from this legal analysis gives us to believe that the Bill is closer to Royal Assent than ever.

The proposal for a 12‑month transition period was rejected.  Instead, the government insists on a graded introduction of regulations, allowing quicker implementation of key public‑health measures—including the generational ban.  So…

  • Royal Assent remains expected toward the end of April 2026.
  • The generational smoking ban (no sales to anyone born ≥ 1 January 2009) remains fully on course to start 1 January 2027.
