What Royal Assent Means – and What Traders Should Do Next

While Royal Assent marks the end of the Parliamentary process, it very much marks the beginning of a phased implementation period for retailers, wholesalers and enforcement authorities.

This update explains what happens next, what does not change immediately, and what traders should now be thinking about over the coming months.

What Has Changed Immediately?

In legal terms, the Act is now law. However, most of its practical impacts will not take effect overnight.

The Act:

  • Establishes a permanent generational ban on tobacco sales to anyone born on or after 1 January 2009
  • Gives Ministers wide powers to regulate tobacco, vapes and other nicotine products, including flavours, packaging, displays and advertising
  • Strengthens Trading Standards enforcement powers and introduces a national framework for retail regulation
  • Expands smoke‑free and vape‑free provisions in specific public settings.

Crucially, many of these measures are framework powers, meaning the detail will follow through secondary legislation.

When Do the New Rules Actually Bite?

The generational tobacco sales ban is expected to take effect from 1 January 2027, at which point retailers will commit an offence if they sell tobacco to anyone born on or after 1 January 2009.

For vaping and nicotine products, the Act itself does not yet ban specific flavours, packaging formats or product types. Instead, it enables government to do so later via regulations, without returning to Parliament for primary legislation.

What Should Traders Be Planning for Now?

Although most changes are deferred, the direction of travel is clear.  Traders should use the coming months to prepare rather than react.

Retailers selling tobacco will eventually need systems capable of verifying date of birth, not simply age. Existing “Challenge 25” policies may need refinement as the banned cohort ages into adulthood.

Staff training materials, refusals logs and due diligence procedures should be reviewed with this in mind.

2. Potential Vape Product Restrictions

The Act gives Ministers powers to regulate:

  1. Flavours
  2. Nicotine content
  3. Packaging and branding
  4. Point‑of‑sale displays

While details are not yet set, traders should assume product ranges may need to change quickly once consultations conclude and regulations are laid.

Stock planning, supplier relationships and display formats should be kept flexible.
