Tobacco and Vapes Act Update: Key Developments July 2026

For licensing professionals, retailers and enforcement authorities, the most significant development in the implementation of the Tobacco and Vapes Act has been the launch of the first major UK-wide consultation on powers created by the Act.  This gives a clear indication of how the Government intends to use its new regulatory powers over vaping products and tobacco packaging.

1. UK Government launches major consultation on vape packaging and displays (10 July 2026)

On 10 July 2026, the UK Government, working with the devolved administrations, launched a 12-week consultation entitled “Tobacco and vapes: packaging, appearance and display”. This is the first substantial implementation step since the Act received Royal Assent on 29 April 2026.

The consultation proposes:

  1. New rules to keep vape products out of sight in retail premises e.g. no display.
  2. Limiting vape device colours to white, black or grey
  3. Standardised white packaging for vapes
  4. Tight restrictions on branding, logos and imagery
  5. Restrictions on flavour descriptions, requiring simple, recognisable flavour names
  6. Extending standardised packaging requirements to all tobacco products, including cigars and cigarette papers.

The Government’s stated objective is to reduce the attractiveness of vaping products to children while maintaining access for adult smokers using vapes as a cessation aid.

You can see that a lot of this, implemented, would affect manufacturers – but the first restriction on keeping vape products out of sight is going to be massive if you have a vape shop or sell vapes in your convenience store.

2. Confirmation of Smoke-Free Generation commencement date

A Parliamentary Written Statement issued on 13 July 2026 confirmed that the Government still intends for the headline Smoke-Free Generation provisions to come into force on 1 January 2027.

From this date, it will be unlawful to sell tobacco products to anyone born on or after 1 January 2009.

The legal age cohort will effectively increase year by year, meaning affected individuals will never legally be able to purchase tobacco.

This confirmation is important for retailers, local authorities and trading standards teams, as many businesses are beginning to prepare staff training, compliance systems and age-verification procedures ahead of implementation.

3. Advertising and sponsorship ban timetable emerging

The same Parliamentary statement provided one of the clearest indications yet of the Government’s timetable for implementing the Act’s advertising controls.  The Government has stated its intention to bring a comprehensive vape and nicotine product advertising and sponsorship ban into force on 1 June 2027.  If implemented as proposed, this will significantly affect:

  1. Point-of-sale advertising 
  2. Retail marketing
  3. Social media promotion
  4. Vape manufacturers
  5. Sponsorship arrangements.

Again, the first three categories on the above list will massively impact on the majority of our client base.  Indeed, many in the vape sector are closely analysing these proposals because they will represent one of the most far-reaching marketing restrictions introduced since tobacco advertising controls.

4. Government still considering outdoor smoking and vape-free place proposals

The Government confirmed that it is currently examining responses to an earlier consultation on:

  • Expanding smoke-free places into certain outdoor settings
  • Creating vape-free areas
  • Establishing heated tobacco-free places.

No final decisions have yet been announced, but this remains one of the most closely watched areas of implementation because of its potential impact on our hospitality venues, outdoor events, transport hubs and public spaces.

5. Devolved administrations actively engaging

Scotland has separately promoted the consultation process and is encouraging responses regarding the packaging, appearance and display of tobacco, vaping and nicotine products.  Scottish ministers have specifically highlighted concerns about youth vaping and the role played by colourful packaging and retail displays.

This suggests that while implementation is being coordinated across the UK, there remains strong political support within the devolved administrations for robust regulation of product presentation and marketing.

Practical implications for licensing and retail businesses:

The key message from the past fortnight is that the Government has now moved from passing the legislation to designing the detailed regulatory framework that will support it.

Retailers should now be planning for:

  • Smoke-Free Generation age checks from January 2027.
  • Potential restrictions on vape displays.
  • Standardised vape packaging requirements.
  • Changes to permitted flavour descriptions.
  • Future advertising and sponsorship restrictions.

Short Summary

The biggest development in the last two weeks has been the 10 July 2026 consultation on vape packaging, appearance and retail displays, which provides the clearest indication yet of how ministers intend to use the powers granted by the Tobacco and Vapes Act.  At the same time, the Government has reaffirmed its target dates of 1 January 2027 for the Smoke-Free Generation provisions and 1 June 2027 for vape advertising restrictions, signalling that implementation is now moving into a practical regulatory phase.

This is likely to be the most important Tobacco and Vapes Act development for licensing practitioners and retailers since Royal Assent.
